These Terms govern general use of our website and form the baseline framework; where a Service Agreement conflicts with these Terms, the Service Agreement controls for that engagement.
Our website content, including descriptions of Services, is provided for general information and does not constitute a binding offer.
4. Website Use
You agree to use our website only for lawful purposes. You may not:
- Use the website in any way that breaches applicable laws or regulations
- Attempt to gain unauthorized access to our systems or networks
- Introduce malicious code, or interfere with the website’s operation

5. AI Services — Nature and Limitations
You acknowledge and agree that:
- Our Services rely on artificial intelligence and automated systems, which may not be error-free and can produce inaccurate or unexpected outputs.
- AI receptionists, voice agents, and automated assistants are tools to support business operations and are not a substitute for professional, legal, medical, or financial advice.
- Where our Services handle bookings, orders, or customer interactions, the client remains responsible for the accuracy of the underlying business information (menus, availability, policies, pricing) and for supervising the system’s use in their business.
- Voice features may involve call recording and transcription; the client is responsible for ensuring appropriate notices and consents are in place for their end-customers.
- Performance of AI systems depends on factors including data quality, third-party platforms (such as messaging and telephony providers), and connectivity, some of which are outside our control.
6. Client Responsibilities
Where you engage us for Services, you agree to:
- Provide accurate, complete, and lawful information required for the project
- Obtain all necessary consents and rights for any data you provide to us for processing
- Use the delivered Services in compliance with applicable laws, including data protection and communications laws
- Maintain the security of any credentials, access, or systems handed over to you
- Comply with the terms of any third-party platforms used in the Services (e.g. WhatsApp Business, telephony providers)
7. Intellectual Property
Unless otherwise agreed in writing:
- All content on our website — including text, graphics, logos, designs, and code — is owned by or licensed to Dygitology and protected by intellectual property laws.
- Ownership of custom deliverables produced under a Service Agreement is determined by that agreement. Dygitology retains ownership of its pre-existing tools, frameworks, methodologies, and general know-how.
- You may not copy, reproduce, or reuse our website content or proprietary materials without written permission.
8. Third-Party Platforms and Services
Our Services may integrate with or rely on third-party platforms (for example, WhatsApp, voice and telephony providers, hosting, and CRM tools). Your use of those platforms is subject to their own terms and policies. We are not responsible for the availability, performance, or actions of third-party platforms.
9. Fees and Payment
Fees, payment schedules, and terms for any engagement are set out in the applicable Service Agreement. We do not currently process payments directly through this website.
10. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other in the course of an engagement and to use it only for the purposes of that engagement. Specific confidentiality terms may be set out in the Service Agreement.
11. Disclaimers
Our website and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. 12. Limitation of Liability

Where liability cannot be excluded, our total aggregate liability for any claim will not exceed the amount paid by you to Dygitology for the specific Service giving rise to the claim, or the amount specified in the applicable Service Agreement.

You agree to indemnify and hold harmless Dygitology from any claims, damages, losses, or expenses arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right, including in connection with data you provide to us for processing.
14. Termination
We may suspend or terminate your access to our website at our discretion, including for breach of these Terms. Termination of any engagement is governed by the applicable Service Agreement.
15. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or our Services will be subject to the exclusive jurisdiction of the state and federal courts located in Alameda County, California, except as otherwise agreed in an applicable Service Agreement.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of our website after changes take effect constitutes acceptance of the revised Terms.
